Terms of Service

Welcome to Millennium Vibe. These Terms of Service ("Terms") govern your access to and use of our platform, including our website, mobile application, and all related services. By creating an account or using our platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Millennium Vibe, you confirm that you are at least 16 years old and that you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our platform. We may update these Terms from time to time, and your continued use of the platform after such changes constitutes acceptance of the revised Terms.

2. Account Registration

  • You must be at least 16 years old to create an account. If you are under 18, you must have parental or guardian consent.
  • You must provide accurate, complete, and up-to-date information during registration and keep your profile information current.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must notify us immediately at [email protected] if you suspect any unauthorized use of your account.

3. User Content

  • You retain ownership of all content you create and upload to Millennium Vibe, including posts, comments, course materials, and media files.
  • By posting content on the platform, you grant Millennium Vibe a non-exclusive, worldwide, royalty-free license to host, display, distribute, and make available your content solely for the purpose of operating and providing the platform's services.
  • You must not post content that is illegal, defamatory, harassing, threatening, discriminatory, sexually explicit involving minors, or that infringes on the intellectual property rights of others.
  • We reserve the right to remove any content that violates these Terms or that we reasonably believe is harmful, at our sole discretion and without prior notice.

4. Creator Terms

  • Creators receive payments through Stripe Connect. By becoming a Creator, you agree to Stripe's Connected Account Agreement and applicable Stripe terms.
  • Millennium Vibe charges a platform fee on each transaction. The current fee percentage is displayed in your Creator dashboard and may be updated with 30 days' notice.
  • Creators are responsible for the accuracy and legality of their content, pricing, and any claims made about their products, courses, or communities.
  • Creators must comply with applicable consumer protection laws regarding refunds. The platform provides tools for managing refunds through Stripe.

5. Payments and Subscriptions

  • All payments are processed securely through Stripe. We do not store your payment card details on our servers.
  • Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
  • You can cancel a subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for the remaining period.
  • Prices may be subject to applicable taxes (including VAT) based on your location. Tax amounts are calculated and collected in accordance with applicable law.

6. Termination

  • You may delete your account at any time from your account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
  • We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide reasonable notice where possible.
  • Upon termination, your right to access the platform ceases immediately. Content you posted in communities may remain visible unless you request its removal.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Millennium Vibe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, including but not limited to loss of profits, data, or business opportunities.

Our total aggregate liability for any claims arising from your use of the platform shall not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the claim, or (b) 100 EUR.

8. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. Any disputes arising from or related to these Terms or your use of the platform shall be submitted to the exclusive jurisdiction of the competent courts in Bucharest, Romania. Nothing in these Terms affects your statutory rights as a consumer under EU law.

10. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by email or through a notice on the platform at least 30 days before they take effect. Your continued use of the platform after the effective date constitutes acceptance of the modified Terms.
